On 18 November 2016 the Court of Arbitration at the Polish Chamber of Commerce in Warsaw (SAKIG) and the University of Wrocław with the support of Allen & Overy organised the conference “An arbitrator in proceedings in front of the arbitration court” (Arbiter w postępowaniu przed sądem polubownym) at the University of Wrocław.

 

Marek Furtek (president of the Court of Arbitration at the Polish Chamber of Commerce in Warsaw) led the conference, which was dedicated to the exchange of ideas between arbitration peers in Poland, and he presided over the inauguration ceremony together with dr. hab. Paweł Borszowski (professor at the University of Wrocław) and prof. dr hab. Tadeusz Ereciński (president of the Supreme Court, head of Civil Chamber, professor at the University of Warsaw).

 

The event attracted a wide range of lawyers from all over Poland, including eminent arbitrators, among others: prof. dr hab. Krystyna Szczepanowska-Kozłowska, mec. Maciej Łaszczuk, dr hab. Przemysław Drapała, dr Marcin Asłanowicz, dr Cezary Wiśniewski, prof. dr hab. Andrzej Szumański, dr hab. Zbigniew Banaszczyk, mec. Piotr Nowaczyk, prof. dr hab. Piotr Machnikowski, dr hab. Łukasz Błaszczak and prof. dr hab. Wojciech Popiołek.

 

The conference aimed at reviewing issues connected with arbitrators, how arbitration courts are formed and their composition being the most characteristic features. The panellists as the authorities of law with wide experience in recognising arbitration disputes, gave answers to the following questions: what are the criteria for the sides when choosing arbitrators and are they aware that the arbitrator chosen is independent from them? They also discussed the thesis that the possibility of forming the composition of an arbitration court by the sides themselves makes arbitration more attractive than public court disputes.

 

Three main panels composed the agenda of the conference:

 

Panel I: The arbitrator and his/her functions in arbitration proceedings

Panel II: Exclusion, appealing and resignation of an arbitrator – selected procedural issues

Panel III: The basis and liability of empowerment of an arbitrator
